A Hong Kong separation agreement can be useful as a record of what two people currently understand about living apart, money, children, property, and practical arrangements. It should not be treated as a court order by itself. The official sources for this draft validate divorce and Family Court context, court forms, and children or maintenance application routes, but they do not validate a single government separation-agreement template.

That is why this guide is written as a cautious heads-of-terms checklist rather than a finished legal form.

Start with the status of the relationship

Before drafting anything, write down whether the couple is married, whether either person has started divorce proceedings, whether there are children, and whether there are urgent safety, housing, immigration, or financial issues. A private agreement may help organise facts, but divorce, custody, maintenance, and ancillary relief can involve court procedure and jurisdiction questions. If one person needs a court order, do not assume a signed private note is enough.

Useful Traditional Chinese labels include 分居協議 for separation agreement, 離婚協議 for divorce agreement, 子女安排 for child arrangements, 贍養費 for maintenance, 家事法庭 for Family Court, and 同意命令 for consent order. Use these as headings or document labels, not as proof that a document has already been approved by a court.

Heads of terms to discuss

A cautious separation checklist can cover who lives where, whether either person will move out, how rent or mortgage payments will be handled, what happens to utilities, who keeps which documents, interim financial support, child living arrangements, school fees, medical costs, travel consent, and communication rules. If there are bank accounts, insurance policies, pensions, businesses, debts, or property outside Hong Kong, list them separately. Do not call the document a court order. Do not hide assets or rely on vague promises about later payment. Do not use a generic overseas template without checking Hong Kong procedure.
