A Polish divorce with a fault request is not only a story about who behaved badly. It is a court file about breakdown of marriage, evidence, children if any, finances, and the maintenance consequences that may follow after the divorce. The Family and Guardianship Code is the legal main reference point for divorce and former-spouse maintenance, while the Civil Procedure Code shapes how evidence is presented. Case databases are useful for seeing the kinds of facts courts discuss, but they should not be treated as a script for accusations.
The practical challenge is that spouses often collect the wrong material. Screenshots, bank transfers, childcare records, medical notes, rent payments, and business income documents can all matter, but only if they are lawful, relevant, dated, and connected to the issues the court must decide. Avoid surveillance, account access, recordings, or workplace pressure that could create separate legal problems.
Start With The Issues The Court Must Understand
Create a short issue map before collecting documents. For the divorce itself, identify facts about the permanent and complete breakdown of marital life: when separation began, whether the spouses still share household responsibilities, and whether there is any realistic prospect of reconciliation. For fault, separate conduct by date and effect: violence, addiction, abandonment, financial control, infidelity, refusal to support the household, or other alleged behaviour.
For maintenance, separate need, earning capacity, living standard, and the effect of the divorce.
Do not write a twenty-page emotional history first. Build a chronology with columns for date, event, document, witness, financial effect, and child-safety relevance. If the fact cannot be supported, mark it as unproven rather than forcing it into the draft petition.
Evidence For Fault
Useful evidence is usually ordinary and specific. It can include correspondence about separation, police or intervention notes, medical or counselling records, proof of separate residence, school or childcare communications, household payment records, bank statements showing unexplained withdrawals, travel or booking records, and witness statements from people who directly observed relevant conduct. Evidence should show what happened, when, and how it affected the marriage.
Fault evidence should be proportionate. A court is unlikely to be helped by every message ever exchanged. Choose the messages that prove a specific point: admission, threat, refusal to pay, agreement about separation, or acknowledgement of a factual event. Keep full originals available so extracts are not misleading.
Evidence For Maintenance
Former-spouse maintenance is document-heavy. Build a current budget and a pre-separation standard-of-living picture. Include rent or mortgage, utilities, food, transport, insurance, medical costs, childcare, education, debt service, and reasonable professional or job-search expenses. Add income evidence: employment contracts, payslips, tax returns, business accounts, dividends, management fees, benefits, and bank inflows.
If one spouse owns a business, avoid guessing at hidden income. When Children Or Safety Are Involved
If there is violence, coercive control, stalking, addiction, or risk to children, the evidence plan should be safety-led. Keep emergency numbers, medical help, and child-protection steps separate from the divorce strategy. Do not delay urgent help because a document file is incomplete. Where children are involved, avoid using them as messengers or evidence collectors.
Also keep child maintenance and former-spouse maintenance distinct in your notes. Fault findings may matter for the former spouse in ways that do not determine support for children. Mixing the two can make the file harder to review.
How To Package The File
Put the divorce judgment request, fault evidence, maintenance evidence, and property questions in separate folders.
