1. 為何遺囑在新加坡重要

若沒有有效遺囑，你的遺產會按 《無遺囑繼承法》（第 146 章）分配，
而且必須跟從嚴格的法定公式。這公式不會顧及你的個人意願、
受養人的特殊需要，或家人的獨特財務狀況。
例如，按該法例，若你已婚兼有子女，配偶只得一半遺產 — 另一半由子女平均分配。
若其中一名子女未成年，其份額會由公署託管人保管至 21 歲，並須繳行政費用。

更重要的是，未婚伴侶 — 不論關係維持多久 — 在無遺囑規則下完全得不到任何分配。
在像新加坡這樣多元文化、法律制度多樣的城市，
不少情侶同居但未結婚，這是一個遺囑可以補上的重大缺口。

2. 法律框架 — 《遺囑法》（第 352 章）

《遺囑法》（第 352 章）適用於所有非穆斯林新加坡人。
穆斯林新加坡人的遺產受伊斯蘭繼承法（faraid）規管，並由 Syariah Court 管理，規則差異很大。
按《遺囑法》訂立遺囑時，形式要求十分嚴格：

年齡：你必須年滿 21 歲才可立遺囑（英格蘭最低為 18 歲）。
例外：現役軍人可在較年輕時訂立特權遺囑。
書面形式：遺囑必須以書面作成。打字遺囑完全有效。
立遺囑人簽署：你必須在遺囑末端簽署。
如身體上無法簽署，可由他人在你面前、按你指示代簽。
兩名見證人，同時在場：兩名見證人必須同時在場，並看見你簽署（或承認你先前的簽署）。
其後，他們都要在你面前簽署。
見證人不得是受益人：若見證人（或其配偶）同時也是受益人，
其在遺囑下的贈與會失效，但遺囑本身仍然有效。

⚠️ 結婚會自動撤銷你的遺囑：
按《遺囑法》第 13 條，婚姻會自動撤銷任何先前所立遺囑，
除非該遺囑是明示預想該婚姻而立。
如你最近已結婚，或計劃結婚，儀式後必須重新立遺囑。
離婚不會撤銷遺囑，但會撤銷其中給前配偶的任何贈與或執行人委任。

3. CPF — 新加坡遺產規劃中最易誤解的資產

對新加坡居民來說，最重要的一點是：你的 CPF 儲蓄不受遺囑約束。
CPF 款項（普通、特別、MediSave 及退休帳戶結餘）不屬於遺產，
不能由遺囑指定去向。它們會按你直接向 CPF Board 作出的 CPF 指定另行分配。

若你去世時未作 CPF 指定，你的 CPF 儲蓄會轉交公署託管人辦事處，
再按無遺囑規則分配 — 不論你的遺囑怎樣寫。
整個程序需時甚長，並會從 CPF 餘額扣除行政費。

要建立或更新 CPF 指定，請經 cpf.gov.sg 登入你的 CPF 帳戶 —
全程少於 15 分鐘，而且你需要兩名不是你指定受益人的見證人。

4. 遺囑應包含的內容

項目	應包含內容
撤銷條款	明確撤銷所有先前遺囑及附錄
執行人	指定主執行人及至少一名替代人；複雜遺產可考慮指定專業執行人

案例研究：Priya Nair 在新加坡的遺產規劃

背景：Priya（44 歲）與 Rahul 結婚，Rahul 是新加坡永久居民。
他們有兩名子女，分別 8 歲及 14 歲。Priya 擁有一個 HDB 單位（與 Rahul 共同持有），
另有一個私人銀行戶口，存款 380,000 新元，
以及各帳戶合共約 210,000 新元的 CPF 結餘。

若沒有規劃，會有甚麼問題：

以聯名持有的 HDB 單位，會在 Priya 去世時按存活權自動轉給 Rahul — 這部分無需處理，
但 Priya 應知道這不受其遺囑控制。
若沒有遺囑，銀行戶口會按《無遺囑繼承法》分配：
Rahul 得 190,000 新元，兩名子女各得 95,000 新元。

Q：我在新加坡需要註冊遺囑嗎？
A: 新加坡沒有強制註冊。
不過，你可自願把遺囑存放於 新加坡法律學會遺囑登記處（wills-registry.sal.sg），費用約 50–70 新元。
這可讓執行人較易在你去世後找到遺囑。
最重要是告知執行人正本存放處 — 找不到的遺囑，視同不存在。
