1. 法律基礎:Employment Act (Cap. 91A)

新加坡僱傭制度主要受 Employment Act (Cap. 91A) 規管。
該法於 2019 年大幅擴闊,涵蓋除公務員及家傭外的所有僱員。
這是重大轉變——以前只有基層員工(每月少於 SGD 2,600)才全面受保障。
由 2019 年 4 月 1 日起,包括 PMETs(專業人士、經理、行政人員及技術員)在內的所有僱員,都受核心條文保障。

僱傭法列明不能以合約剝奪的最低法定權益。
任何條款如低於法例要求,與法例牴觸的部分即屬無效,並以法定最低標準為準。
例如,你不能書面同意放棄年假,或接受低於法定通知期的補償。

2. 主要僱傭條款(KETs)— 2016 年 4 月起強制

根據《僱傭(主要僱傭條款)規例》,僱主須在僱員開工後 14 日內發出 書面主要僱傭條款(KETs)
未發出 KETs 屬違規,可被人力部處罰。KETs 必須包括:

  • 僱主及僱員全名

  • 職位、主要職責及責任

  • 開始日期(如為固定期,另列完結日期)

  • 試用期長度(如有)

  • 工作時間及休息日

  • 薪金、支付頻率及日期

  • 年假權益

4. 限制性契諾 — 哪些可執行,哪些不可

新加坡法院採用限制貿易原則:限制性契諾只會在保護合法專有權益,且範圍合理時才可執行。
重點原則:

  • 非競業條款:如期限合理(通常 6–12 個月)、地域範圍合理(限於僱主實際營運地區),以及受限活動類型合理,便可執行。
    若條款寫成「不得在任何科技公司工作」,很可能無效。

  • 客戶挖角限制:若僱員可直接接觸客戶,且限制有時限(通常 12 個月),一般可維持。

  • 員工挖角限制:若針對對團隊成員有特定影響力的高級僱員,亦一般可維持。

  • 園地休假條款:僱主可要求僱員在通知期內留在家中,並繼續支付薪金。
    這是離職後限制性契諾的合法替代方案。

與某些司法管轄區不同,新加坡法院要求以金錢補償作為限制性契諾有效的交換。
不過,合理性測試仍會嚴格適用。


案例:Wei Ling 於新加坡金融科技公司的僱傭合約

背景:Wei Ling(29 歲)收到新加坡金融科技初創公司的資料分析員 offer:基本月薪 SGD 6,500、試用期 3 個月、12 個月非競業限制(限於「APAC 金融科技行業」),以及一條 IP 轉讓條款,涵蓋「工時內外作出的所有發明」。

Caira 找出嘅問題:

  • 非競業限制過闊:「整個 APAC 金融科技」並無地域限制,亦無排除特定職位,論上已超出保護僱主利益所需。Caira 指出此條款或不可執行,並建議收窄為「新加坡及 [指定國家/客戶名單]」,期限改為 6 個月。

Q: 如果我月入超過 SGD 4,500,僱傭法還保障我嗎?
A: 可以——自 2019 年擴展後,所有僱員(包括高收入者)都受僱傭法核心條文保障。
不過,超時薪酬及休息日薪酬等保障,只適用於基本月薪不超過 SGD 2,600 的僱員(以前為 SGD 2,600,2021 年資料,限額或已更新)。

Q: 我的僱主可否在未經我同意下扣薪?
A: 扣薪受僱傭法嚴格限制。
可扣項目包括 CPF 供款、入息稅、獲授權的僱員還款,以及就損壞或損失而同意的扣款。
任意扣薪屬違法,而所有可扣款項(CPF 除外)合共不可超過一個月薪金的 50%。

Q: 合約中的非競業條款會自動可執行嗎?
A: 不會。
在新加坡,非競業條款只有通過限制貿易合理性測試才可執行。
法院會評估它是否真正保護合法專有權益(如保密客戶關係、商業秘密),以及其範圍(期限、地域、活動)是否與該權益相稱。
過於寬泛的條款,法院通常會撤銷或修改。

Q: 如果僱主未準時出糧,我可以怎樣做?
A: 根據僱傭法,薪金須於薪金期結束後 7 日內支付。
如僱主遲發薪金,你可透過 iECT 線上向 僱傭申索審裁處(ECT) 申索。
